The Factors and Negotiation Software™ “FANS” is influenced from the Education Department general Administrative Regulations “Edgar Act”: where school districts must have a minimum of three written quotes for purchases $3500 to $49,999 and also competitively bid for purchases $50,000 or greater (not new). Price or rate quotations (documented in writing) must be obtained from an adequate number of qualified sources for all purchases in this range (new interpretation).

Implementation negotiation is very similar to mediation but can apply to a wider variety of situations and is more flexible in its form. Like the mediator, the facilitator must design a process for addressing the task at hand in a fair and efficient manner. The desired outcome of the facilitator’s work is typically less strictly defined than that of the “legal” mediator.

When facilitation occurs, the parties utilizing the facilitator may not be in dispute or deadlock about an issue.
